Further concessions for Ukrainian nationals - As of 4th March 2022

Extended Family Members

The Home Secretary has stated that the UK government will be establishing a scheme to allow UK citizens and ILR holders to bring extended family members to the UK. It has now published guidance on its concession for Ukrainian family members, which is available here.

Those who qualify are as follows: -

✓ Immediate family members:
• spouse or civil partner
• unmarried partner (you must have been living together in a relationship for at least two years)
• child who is under 18
• parent (if you are under 18)
• fiancé(e) or proposed civil partner

✓ Extended family members:
• parent (if sponsor is over 18)
• child who is over 18
• grandparent
• grandchild or your partner’s grandchild
• brother or sister

✓ Immediate family members of an extended family member:
• spouse or civil partner of an extended family member
• child under 18 of an extended family member
• parent of a child under 18 who is an extended family member
• fiancé(e) or proposed civil partner of an extended family member

It is a free route which can be applied for online. If granted, leave will be granted with a right to work, study, and access public funds.

The Application form requires the following documents:

1. Passport (or proof of identity);
2. Evidence of sponsor’s immigration status;
3. Evidence of relationship with sponsor;
4. Proof of address in Ukraine.

Humanitarian Sponsorship Pathway

On 1 March 2022 the Home Secretary also announced that the Home Office would establish a route to the UK for Ukranians without family ties in the UK. . The announcement said that applicants will be able to “match with individuals, charities, businesses, and community groups”. Successful applicants will be granted 12 months’ leave with a right to work and recourse to public services.

Whilst awaiting detail and implementation of these announcements we reiterate that Ukrainian nationals have a free standing right to international protection that obliges the UK authorities to offer sanctuary without precondition.
